Algemene voorwaarden

Deze voorwaarden gelden voor het website-abonnement van LokaalWebsite, onderdeel van The Nerdinarium (“wij”, “ons”), gevestigd in Nederland (KvK 42092954, btw-id NL005491455B30). De dienst wordt geleverd aan ondernemers (zakelijke klanten).

1. Wat wij leveren

Wij bouwen, hosten en onderhouden een professionele website voor uw bedrijf. Het abonnement omvat, afhankelijk van het gekozen pakket:

• De website (ontwerp, opbouw en teksten) op basis van de door u aangeleverde gegevens - een sterke één-pagina website met meerdere secties.
• Hosting, SSL-beveiliging (https) en de domeinnaam.
• Vindbaarheid in Google (nette paginastructuur en LocalBusiness-gegevens).
• Een contact-/offerteformulier dat naar uw e-mail doorstuurt.
• Uw echte Google-beoordeling en kaart, indien beschikbaar (nooit verzonnen).
• Zelf aanpassen (alle abonnementen): via uw eigen beheerpagina past u uw gegevens - zoals diensten, prijzen, openingstijden, foto's en teksten - zelf aan: gratis, onbeperkt en zo vaak u wilt.
• Basis omvat daarnaast 1-2 maatwerkwijzigingen per maand door ons: aanpassingen die niet via de beheerpagina kunnen (bijvoorbeeld een tekstuele herschrijving of een kleine opmaakwijziging).
• Pro voegt toe: tot 4 maatwerkwijzigingen per maand - ook grotere, zoals een nieuw ontwerp of extra secties - een maandrapport, een WhatsApp-knop, hulp bij het koppelen van uw Google-bedrijfsprofiel en voorrang bij support.

2. Wat het kost

• Basis: €59 per maand. Pro: €99 per maand. Bedragen zijn inclusief btw (21%).
• Geen opstartkosten. Vooraf te voldoen via automatische incasso of kaartbetaling.
• Prijswijzigingen kondigen wij minimaal één maand vooraf aan.

3. Looptijd en opzegging

• Het abonnement is maandelijks en per maand opzegbaar (geen jaarcontract).
• Opzeggen doet u door te mailen naar [email protected]. De opzegging gaat in aan het einde van de lopende betaalde maand; tot dan blijft uw website online.

• Bij het uitblijven van betaling kunnen wij de website na een herinnering tijdelijk offline halen.

4. Eigendom

• Gedurende het abonnement heeft u volledig gebruiksrecht op uw website.
• De onderliggende techniek, het template en de hosting blijven ons eigendom en maken deel uit van de dienst.
• Bij opzegging stopt de dienst en gaat de website offline - vergelijkbaar met andere abonnementsdiensten.
• Uw eigen aangeleverde teksten, logo en foto's blijven van u en krijgt u op verzoek terug.

5. Wat wij van u nodig hebben

• Correcte bedrijfsgegevens (naam, telefoon, e-mail, werkgebied, openingstijden).
• Eventueel logo en foto's (anders gebruiken wij nette standaardelementen).
• Alleen echte klantbeoordelingen - wij plaatsen nooit verzonnen reviews of een onjuiste beoordelingsscore (wettelijk verplicht).

6. Domeinnaam

• Geeft u een gewenste domeinnaam op, dan registreren wij die voor u; registratie en verlenging zijn bij het abonnement inbegrepen.
• Geen voorkeur? Dan kiezen wij een passende, beschikbare domeinnaam voor u en registreren die.
• Een andere domeinnaam kiezen vóór registratie is gratis; ná registratie kost een andere domeinnaam €10 incl. btw, omdat registraties niet restitueerbaar zijn.
• Door ons geregistreerde domeinnamen registreren wij namens u; de registratie hoort bij de dienst. Zegt u op, dan kunt u tot de einddatum van uw abonnement per e-mail vragen de domeinnaam naar u over te dragen (kosteloos; u zet de registratie dan bij een eigen provider voort). Vraagt u geen overdracht aan, dan laten wij de domeinnaam na afloop verlopen en komt deze weer vrij.
• Heeft u al een domein? Dan gebruiken wij die. U blijft eigenaar en past alleen twee DNS-records aan (met onze uitleg) - wijzig nooit uw nameservers.
• DNS-wijzigingen kunnen tot 24–48 uur duren voordat ze wereldwijd actief zijn.

7. Wijzigingen en bereikbaarheid

Uw eigen gegevens (diensten, openingstijden, foto's, teksten) past u zelf aan via uw beheerpagina - gratis en onbeperkt. Maatwerkwijzigingen door ons vraagt u per e-mail aan; die vallen binnen uw pakket (Basis: 1-2 per maand, Pro: tot 4 per maand, ook grotere). Wijzigingen daarbuiten offreren wij apart.

8. Aansprakelijkheid

Wij doen ons uiterste best voor een goed werkende, veilige website met hoge beschikbaarheid. Wij zijn niet aansprakelijk voor schade door storingen buiten onze macht (bijv. uitval bij een leverancier of overmacht).

9. Privacy

Wij verwerken persoonsgegevens conform de AVG. Zie onze privacyverklaring.

Verwerkersovereenkomst (gegevens van úw klanten). Via het contactformulier op uw website verwerken wij persoonsgegevens van uw klanten (naam, e-mailadres, telefoonnummer en de inhoud van hun bericht) namens u. Voor die gegevens bent u verwerkingsverantwoordelijke en zijn wij verwerker; dit artikel geldt als verwerkersovereenkomst in de zin van art. 28 AVG. Wij verwerken deze gegevens uitsluitend om ze aan u door te sturen en (bij Pro) geanonimiseerd te tellen voor uw maandrapport — nooit voor eigen doeleinden. Wij schakelen alleen de subverwerkers in die in onze privacyverklaring staan, beveiligen de gegevens passend, informeren u zonder onredelijke vertraging over een datalek dat uw klanten raakt, helpen u bij verzoeken van betrokkenen (inzage, verwijdering) en verwijderen deze gegevens uiterlijk bij het einde van uw abonnement.

10. Toepasselijk recht

Op deze voorwaarden is Nederlands recht van toepassing. Door het bestelproces af te ronden, gaat u akkoord met deze voorwaarden, het opzeg- en restitutiebeleid en de privacyverklaring.

These terms apply to the website subscription of LokaalWebsite, part of The Nerdinarium (“we”, “us”), established in the Netherlands (CoC 42092954, VAT id NL005491455B30). The service is provided to businesses (commercial customers). In case of any conflict, the Dutch version prevails.

1. What we provide

We build, host and maintain a professional website for your business. The subscription includes, depending on the chosen package:

• The website (design, build and copy) based on the information you supply - a strong single-page website with multiple sections.
• Hosting, SSL security (https) and the domain name.
• Findability on Google (proper page structure and LocalBusiness data).
• A contact/quote form that forwards to your email.
• Your real Google rating and map, where available (never fabricated).
• Self-service editing (all plans): through your own editing page you can update your details - such as services, prices, opening hours, photos and text - yourself: free, unlimited, as often as you like.
• Basis additionally includes 1-2 custom changes per month by us: changes that cannot be made through the editing page (for example a textual rewrite or a small layout change).
• Pro adds: up to 4 custom changes per month - including bigger ones, like a new design or extra sections - a monthly report, a WhatsApp button, help linking your Google Business Profile, and priority support.

2. Pricing

• Basis: €59 per month. Pro: €99 per month. Amounts include VAT (21%).
• No setup fee. Payable in advance by direct debit or card.
• We announce any price changes at least one month in advance.

3. Term and cancellation

• The subscription is monthly and cancellable each month (no annual contract).
• You cancel by emailing [email protected]. Cancellation takes effect at the end of the current paid month; your website stays online until then.

• In case of non-payment we may temporarily take the website offline after a reminder.

4. Ownership

• During the subscription you have full right of use of your website.
• The underlying technology, the template and the hosting remain our property and form part of the service.
• On cancellation the service ends and the website goes offline - comparable to other subscription services.
• Your own supplied texts, logo and photos remain yours and are returned on request.

5. What we need from you

• Correct business details (name, phone, email, service area, opening hours).
• Optionally a logo and photos (otherwise we use tidy default elements).
• Only genuine customer reviews - we never display invented reviews or an incorrect rating score (required by law).

6. Domain name

• Provide a preferred domain and we register it for you; registration and renewal are included in the subscription.
• No preference? We choose a suitable available domain for you and register it.
• Choosing a different domain before registration is free; after registration a different domain costs €10 incl. VAT, as registrations are non-refundable.
• Domains we register are registered on your behalf; the registration is part of the service. If you cancel, you can request by email - up to your subscription end date - to have the domain transferred to you (free of charge; you then continue the registration with your own provider). If you do not request a transfer, we let the domain lapse after your subscription ends and it becomes publicly available again.
• Already own a domain? We use it. You remain the owner and change only two DNS records (with our guidance) - never change your nameservers.
• DNS changes can take 24–48 hours to become active worldwide.

7. Changes and availability

You edit your own details (services, opening hours, photos, texts) yourself via your editing page - free and unlimited. Custom changes made by us are requested by email and fall within your plan (Basis: 1-2 per month, Pro: up to 4 per month, including larger ones). Anything beyond that is quoted separately.

8. Liability

We do our utmost to provide a well-functioning, secure website with high availability. We are not liable for damage caused by failures beyond our control (e.g. a supplier outage or force majeure).

9. Privacy

We process personal data in accordance with the GDPR. See our privacy statement.

Data processing agreement (your customers' data). Through the contact form on your website we process personal data of your customers (name, email address, phone number and the content of their message) on your behalf. For that data you are the controller and we are the processor; this clause constitutes a data processing agreement within the meaning of art. 28 GDPR. We process this data solely to forward it to you and (on Pro) to count it anonymously for your monthly report — never for our own purposes. We only engage the sub-processors listed in our privacy statement, secure the data appropriately, inform you without undue delay of a data breach affecting your customers, assist you with data-subject requests (access, erasure) and delete this data no later than the end of your subscription.

10. Governing law

These terms are governed by the law of the Netherlands. By completing the order process you agree to these terms, the cancellation and refund policy and the privacy statement.
